Welcome to Vinny & Charles. The website vinnyandcharles.com and its related services, products, websites, tools and applications (Website) is owned and operated by Cad Culture Pty Ltd (ABN 96607013365) trading as Vinny and Charles.

These Terms and Conditions govern the supply of any Products ordered by you on the Website or by any other means, including by telephone or email. Other terms and conditions contained in our Privacy Policy and Website Terms of Service also form part of our agreement with you. Please read them carefully.

By using the Website or by placing an order with us or by giving your acceptance to these terms, you agree to be bound by these Terms and Conditions. If you don’t agree to be bound by these Terms and Conditions, you must not use the Website.

These Terms and Conditions may be updated by us from time to time. Each order placed on the Website will be a separate contract and the Terms and Conditions that apply to an order will be the version of the Terms and Conditions that is on the Website at the time you place your order. Each time you use our Website you should revisit these Terms and Conditions.

These Terms and Conditions comply with the latest Australian Consumer Law as regulated by the Australian Competition and Consumer Commission (ACCC).

DEFINITIONS

In these Terms and Conditions unless inconsistent with the context or subject matter the following terms have the corresponding meanings:

1. Applicable Laws: any Applicable Laws (including orders, by-laws and regulations) in the jurisdiction in which you, and any User you are interacting with are located or which in any way govern or affect the use of the Website;
2. Australian Consumer Law: the Australian Consumer Law (as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth));
3. GST: has the meaning given in A New Tax System (Goods and Services Tax) Act 1999 (Cth);
4. Loss: any loss, liability, cost, charge, expense, tax, duty or damage of any nature whatsoever, including special, incidental, or consequential damages, losses or expenses (howsoever arising or caused, including, without limitation, negligence);
5. our, us and we: Vinny & Charles;
6. Privacy Policy: our privacy policy is accessible on the Website;
7. Products: has the meaning given to it under clause 2 and includes any other products offered for sale on the Website;
8. User: any person who uses the Website; and
9. you and your: a User.

 

TERMS AND CONDITIONS

1. Compliance with Australian Consumer Law

We comply with the Australian Consumer Law. Under the Australian Consumer Law, consumers have certain rights in relation to the products and services we provide. Nothing in these terms excludes, restricts, or modifies any statutory rights under the Australian Consumer Law.

2. Refund, Repair, and Replacement Policy

No change of mind refunds.

At Vinny & Charles, we believe in the quality of our work. Each piece is custom made just for you. If you receive a product that is faulty, damaged, or does not meet the description provided, you are entitled to a refund, repair, or replacement in accordance with the Australian Consumer Law. 

3. Guarantees and Warranties

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

4. Shipping and Delivery

We offer various shipping options. Delivery times and costs are calculated at checkout based on your location and the shipping method selected. While we strive to ensure timely delivery, there may be occasional delays beyond our control. You will be notified of any significant delays as soon as we become aware of them.

Please make sure that the shipping address provided is correct as this is the one we will ship to. A tracking number will be provided on all orders when they ship out. Delivery times are estimates only. Insurance is not included. If you would like the piece to be insured, please let us know. There will be a charge for changes to address after the order has shipped.

Shipping within Australia: All items are sent with Australia Post - Express Shipping with tracking. This generally takes 2-5 business days. A signature will be required upon delivery. Shipping is FREE. Pickup is optional from our Perth studio Workshop.

Shipping Internationally: International Orders ship with DHL Express courier, which includes tracking and normally takes between 2-7 days. Shipping is FREE. International customs and import duties differ from country to country. Buyers are responsible for any customs and duties that may apply. Please be in touch with your local customs office if you have any concerns about import duties. Once your item has shipped you will receive a message from DHL regarding any fees payable.

Shipping times are a guideline only - we do not guarantee shipping timelines.

5. Payment Terms

Payment for all products is due immediately upon placing an order unless otherwise stated. We accept various payment methods, which will be detailed in the checkout process. For custom designs or special orders, a deposit may be required, with the balance payable upon completion.

Full payment is required before any items will be shipped. For our Australian customers - for payment instalments, we offer Afterpay through our website.

6. Limitation of Liability

To the fullest extent permitted by law, Vinny & Charles excludes all liability for any loss or damage, including direct, indirect, or consequential damages, arising out of or in connection with your use of our website or products. Our liability is limited to the maximum extent permitted by law.

In no case shall Vinny & Charles, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

We respect your privacy and are committed to protecting your personal information. Our Privacy Policy outlines how we collect, use, and safeguard your data. Do Not Sell My Personal Information outlines how we collect personal information from your interactions with us and that we may share this personal information with third parties, including advertising partners.
